The issue of child support is one of the most central and sensitive in family proceedings. Beyond the financial aspect, these are decisions that affect the sense of justice, security and balance of each family member – especially the children.
Proper management of a child support claim requires a combination of deep legal understanding and human sensitivity , to ensure that the solution is not only fair on paper – but also feasible, fair and sustainable over time.
Alimony – Rights, Limits, and Strategic Aspects
In Israel, a married woman is entitled to alimony from her husband as long as the marriage is valid according to the personal law applicable to her.
However, the right to alimony is not absolute – in cases of infidelity, abandonment without justification, or significant financial independence, the court may reduce or dismiss the claim.
In addition, when there is a prolonged separation, the court or tribunal may not recognize the entitlement to alimony.
Therefore, managing a spousal support claim requires precise timing, a deep halachic and legal understanding , and the construction of a strategy tailored to the complexity of the relationship between the parties and the specific circumstances of the case.
Child support – not just a legal obligation, but a parental value
Child support expresses the obligation of parents to provide for their children’s needs – including food, housing, education, health and other expenses.
Since the central ruling in Case No. 919/15, the courts have been examining the amount of child support based on the income of both parents , the division of time spent together , and the actual expenses of the child’s upbringing and living .
The goal is to create parental equality alongside financial stability for the child , while striking a fair balance between the parents’ responsibilities.
The latest ruling takes a “stability versus flexibility” approach – meaning that the amount of alimony can only be changed when there is a significant change in circumstances in the financial or family situation.
Who is authorized to hear alimony claims?
The issue of authority is particularly important, and sometimes determines the outcome of the entire procedure.
Spouse support – a parallel authority for both the court and the rabbinical court – where in the rabbinical court, the issue of spouse support must be linked to the divorce claim.
Child support – parallel authority exists for both the court and the rabbinical court (Amendment 6 to the Rabbinical Court Jurisdiction Law (Marriage or Divorce) 5776-2025 for two years, even without the consent of both parties, in effect returning the parallel consent to the court to discuss child support (contrary to the determination in the Supreme Court ruling (DNC 15839-03-25)).
Understanding the judicial authority and choosing the right court for the issue of spousal support and/or child support are part of the strategic steps in the support process, and this also has an impact on the management of the legal case.
